Agreement

By using magicsmoke.ai (the “Service”), you agree to these terms. The Service is operated by Magic Smoke Inc., a Delaware corporation based in Dallas, Texas. If you do not agree, do not use the Service.

What the Service does

Magic Smoke helps you plan hardware projects. You describe what you want to build, and the Service uses AI to generate parts lists, build instructions, code, wiring diagrams, and concept renders. The Service is a planning tool, not a guarantee that any project will work as described.

Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement.

Accounts

You are responsible for keeping your account credentials secure. You are responsible for all activity that occurs under your account.

Your content

You own the project data you create using Magic Smoke, including descriptions, instructions, and any code generated for your projects. You grant us a license to store, process, and display your content as needed to provide the Service.

AI-generated content

Parts lists, build instructions, code, wiring diagrams, and design images are generated by AI. While we aim for accuracy, this content may contain errors, inaccuracies, or omissions.

You are solely responsible for verifying all AI-generated content before purchasing components, assembling hardware, or uploading code. This includes verifying electrical specifications, component compatibility, safety considerations, and code correctness.

Magic Smoke is not liable for any damage, injury, or loss resulting from the use of AI-generated plans, instructions, or code.

Third-party links

The Service may include links to third-party suppliers and retailers for purchasing components. We do not control these sites and are not responsible for their products, pricing, availability, or practices.

Published projects

If you publish a project, it becomes publicly visible. You are responsible for the content you publish. We may remove published content that violates these terms or is otherwise inappropriate.

Prohibited use

You agree not to:

• Use the Service to design weapons, explosives, or anything intended to cause harm
• Abuse, overload, or interfere with the Service
• Attempt to access other users' data
• Resell or redistribute the Service without permission

Availability and changes

The Service is currently in beta. We may change, suspend, or discontinue any part of the Service at any time. We do not guarantee uptime or availability.

Limitation of liability

To the fullest extent permitted by law, Magic Smoke Inc. is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damage to hardware, personal injury, or financial loss arising from your use of the Service or reliance on AI-generated content. Our total liability is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that AI-generated content is accurate, complete, safe, or suitable for any particular purpose.

Governing law

These terms are governed by the laws of the State of Texas. Any disputes will be resolved in the courts located in Dallas County, Texas.

Changes to these terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
